1. Services Provided
Better Website Services offers digital marketing, web design, web development, SEO, and hosting services. All projects, scopes of work, and specific deliverables will be outlined in a separate Statement of Work (SOW) or Service Agreement signed by both parties prior to the commencement of any project.
2. Intellectual Property Rights
Other than the content you own, under these Terms, Better Website Services and/or its licensors own all the intellectual property rights and materials contained in this Website. Upon full payment of all project fees, ownership of the final website design, code, and assets created specifically for the client will be transferred to the client, subject to the specific terms of the individual Service Agreement.
3. Payments and Billing
Payment terms will be established in the individual project proposal or Service Agreement. We generally require an initial deposit before work commences, with milestones or final payment due upon project completion or deployment. Failure to pay may result in suspension of services or withholding of final deliverables.
Payments are processed by Stripe. By paying through a payment link, you also agree to Stripe’s terms for the payment method you use, including authorizing a debit from your bank account if you pay by bank transfer (ACH). Receipts are emailed to you by Stripe.
Deposits are non-refundable once work on your project has started. Any other refunds are handled as set out in your Service Agreement and, where agreed, are returned to the original payment method.
4. Client Responsibilities
Clients are responsible for providing all necessary text, images, and other content required for the project in a timely manner, unless content creation is explicitly included in the Service Agreement. Delays in providing content may result in corresponding delays to the project timeline.
5. Limitation of Liability
In no event shall Better Website Services, nor any of its officers, directors, and employees, be held liable for anything arising out of or in any way connected with your use of this Website or the services provided. Better Website Services shall not be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this Website.
6. Warranties and Revisions
We pride ourselves on quality. Our websites are guaranteed to function as outlined in the initial proposal at the time of launch. Ongoing maintenance, updates, and future compatibility are not guaranteed unless an ongoing Maintenance Agreement is active. Post-launch revisions outside of the original scope will be billed at our standard hourly rate.
7. Termination
We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
8. Governing Law
These Terms will be governed by and interpreted in accordance with the laws of the jurisdiction in which Better Website Services operates, and you submit to the non-exclusive jurisdiction of the state and federal courts located there for the resolution of any disputes.
